Terms of Service

1. Acceptance of terms

By accessing or using Zerpd ("the Service") at zerpd.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of service

Zerpd is a social media growth platform that provides businesses and creators with:

  • ✓Instagram analytics and audience insights
  • ✓DM automation and bot builder tools
  • ✓AI-powered content generation and ideation
  • ✓Competitor analysis and benchmarking
  • ✓Workflow automations for social media accounts

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User accounts

Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and all activity that occurs under your account.

Eligibility

You must be at least 18 years old to use the Service. By using Zerpd, you represent that you meet this requirement.

Account security

You must notify us immediately at hello@zerpd.com if you become aware of any unauthorised use of your account or any other security breach.

4. Subscription and billing

Zerpd offers both free and paid subscription plans. The following terms apply to paid plans:

  • ·Billing cycle: Paid plans are billed monthly or annually in advance. Fees are non-refundable except where required by law.
  • ·Automatic renewal: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
  • ·Price changes: We may change subscription pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
  • ·Cancellation: You may cancel your subscription at any time from your billing settings. Access continues until the end of the current paid period.
  • ·Payment processing: Payments are processed securely by Stripe. Zerpd does not store your payment card details.

5. Acceptable use

You agree not to use the Service to:

  • ✕Violate any applicable law, regulation, or third-party rights
  • ✕Send spam, unsolicited messages, or harassing communications
  • ✕Violate Instagram's, TikTok's, or any other platform's terms of service
  • ✕Attempt to scrape, reverse-engineer, or extract our proprietary algorithms
  • ✕Use automation to access the Service in a way that exceeds normal usage
  • ✕Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • ✕Upload or transmit malware, viruses, or any malicious code

Violation of these terms may result in immediate account suspension or termination without refund.

6. Intellectual property

Our property

The Service, including its design, code, features, branding, and content created by Zerpd, is owned by Zerpd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your content

You retain ownership of any content you create using Zerpd's AI tools. By using the Service, you grant Zerpd a limited licence to process your content solely to provide the Service to you.

Feedback

Any feedback, suggestions, or ideas you submit to us may be used by Zerpd without obligation or compensation to you.

7. Termination

Either party may terminate the relationship at any time:

  • ·By you: Cancel your subscription and delete your account at any time from account settings.
  • ·By us: We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days, subject to legal retention requirements. Sections 6, 8, and 9 survive termination.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZERPD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of:

  • ·The amount you paid to Zerpd in the 12 months preceding the claim, or
  • ·€100 (one hundred euros)

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

9. Changes to terms

We may update these Terms from time to time. We will notify you of material changes by email or via a prominent notice on the platform at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

10. Governing law

These Terms are governed by the laws of Ireland. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to your statutory consumer rights.
